Terms of Service for NJ Home Helpers

Effective Date: January 15, 2025

1. Agreement and Acceptance These Terms of Service govern your access to and use of services provided by NJ Home Helpers, including the website and any consultations, estimates, project management, or contracted work. By accessing or using our website or engaging our services, you agree to be bound by these terms. If you do not agree with these terms, do not use our services.

2. Services Provided NJ Home Helpers offers a range of services related to residential property improvement, project coordination, pre-listing preparation, cost estimating, staging advice, and consultation. Specific services, deliverables, timelines, and fees will be outlined in separate proposals, estimates, or service agreements provided to clients. These Terms apply in addition to any service-specific agreements.

3. Estimates, Proposals, and Scope Changes Any estimate or proposal provided by NJ Home Helpers represents an approximation based on information available at the time of assessment. Final costs may vary due to hidden conditions, permit requirements, material availability, or client-requested changes. NJ Home Helpers will notify clients of material changes to scope or cost and will seek written approval for any additional work beyond the original scope.

4. Client Responsibilities Clients must provide accurate property information, access to the property as required for inspections and work, and timely decisions when approvals are requested. Delays resulting from client inaction may lead to schedule changes and additional costs. Clients are responsible for disclosing any known site hazards, building code violations, or other conditions that could affect the safe completion of the work.

5. Third-Party Contractors and Subcontractors NJ Home Helpers may engage subcontractors and vendors to perform portions of the work. While we vet and coordinate qualified tradespeople, subcontractors remain responsible for their own workmanship. NJ Home Helpers will manage contractor relationships and address quality concerns in coordination with subcontractors. Clients agree that NJ Home Helpers is not the direct employer of subcontracted trades but will act as the principal coordinator.

6. Payment Terms Payment schedules, deposit requirements, and final invoice terms will be specified in the service agreement or contract. Unless otherwise agreed, deposits are required to secure scheduling and to cover initial procurement costs. Invoices are due as specified; late payments may incur interest or suspension of services. Clients are responsible for any expenses associated with collections or legal enforcement of unpaid invoices.

7. Cancellations and Rescheduling Clients may cancel or reschedule services with reasonable notice. For on-site appointments or scheduled work, cancellation fees may apply to cover lost contractor time or materials procured. Specific cancellation terms will be included in service agreements.

8. Warranties and Limitations NJ Home Helpers stands behind its coordination and advisory services and will work to remedy issues related to the services we provide. For work performed by subcontractors, applicable warranties will typically be provided by the subcontractor or manufacturer. NJ Home Helpers does not warrant unforeseen outcomes such as market conditions or resale value. To the fullest extent permitted by law, NJ Home Helpers disclaims liability for incidental, consequential, or punitive damages arising out of the services provided.

9. Insurance and Liability NJ Home Helpers maintains general liability insurance appropriate to its operations. Clients are responsible for maintaining any property insurance needed for their own protection. Where required by law or as agreed in a contract, subcontractors will carry appropriate insurance. NJ Home Helpers is not liable for damage arising from pre-existing conditions, undisclosed hazards, or circumstances outside of our control.

10. Intellectual Property All materials, proposals, images, and recommendations provided by NJ Home Helpers are the intellectual property of NJ Home Helpers or its licensors unless otherwise specified in writing. Clients are granted a limited license to use materials for the purposes of the agreed project. Reproduction or distribution without permission is prohibited.

11. Privacy and Data Use of personal information is governed by our Privacy Policy. By engaging our services, you consent to the collection and use of data as described in that policy.

12. Dispute Resolution We aim to resolve disputes amicably and encourage clients to contact us to address concerns. If an amicable resolution cannot be reached, parties may seek mediation or pursue legal remedies in accordance with applicable law. Any legal action shall be brought in the appropriate jurisdiction where NJ Home Helpers operates.

13. Termination Either party may terminate a service agreement for material breach if the breach is not cured within a reasonable period after written notice. Termination does not relieve the client of payment obligations for services already rendered or for non-cancellable expenses.

14. Changes to Terms NJ Home Helpers may update these Terms of Service from time to time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.

15. Contact For questions regarding these Terms, please contact NJ Home Helpers through the contact channels provided on our website. We are committed to clear communication and fair business practices.
